Terms of Use

These Terms of Use govern access to and use of The Work Crew website, order forms, application forms, email communications, and fixed-scope business support services. By using the website, submitting an order brief, applying to join the Crew, paying for a service, or communicating with The Work Crew, you agree to these Terms, the Order Policy, and the Privacy Policy.

The Work Crew is an early-stage managed service model. We are not an open freelance marketplace, staffing agency, employment agency, legal advisor, financial advisor, tax advisor, medical advisor, immigration advisor, or regulated professional service provider unless expressly stated in writing for a specific engagement.

1. Services

The Work Crew provides fixed-scope business support packages such as social media assistance, content support, design support, website review, Google presence suggestions, digital admin support, and related practical business tasks. Services are limited to the package, description, order brief, written confirmation, and any agreed written scope.

We may refuse, pause, cancel, or decline any request that is unclear, outside scope, unlawful, unsafe, misleading, discriminatory, abusive, impossible to complete, or unsuitable for The Work Crew model.

2. No Professional Advice

Unless expressly agreed in a separate signed agreement, our services are general business, marketing, content, administrative, design, and digital support services only. Nothing we provide should be treated as legal, tax, accounting, financial, medical, immigration, employment, compliance, or other regulated professional advice.

You are responsible for obtaining independent professional advice where required before relying on, publishing, submitting, or acting on any deliverable.

3. Accounts and Forms

You must provide accurate, complete, and current information in all order briefs, application forms, emails, files, links, instructions, and communications. We are not responsible for delays, errors, rework, rejected deliverables, or business losses caused by incomplete, inaccurate, late, misleading, inaccessible, or unclear information supplied by you.

4. Client Materials

You represent and warrant that you own or have the necessary rights, licences, permissions, and consents to provide all text, images, logos, designs, documents, data, files, credentials, examples, links, brand assets, and other materials submitted to The Work Crew. You agree not to provide material that infringes intellectual property, privacy, publicity, confidentiality, employment, consumer protection, platform, or other rights.

You grant The Work Crew a limited licence to access, use, copy, modify, format, process, and share Client Materials as reasonably necessary to review the order, complete the service, manage quality, communicate with you, maintain records, and operate the business.

5. Deliverables and Ownership

After full payment is received and the order is closed, you will own the final custom deliverables specifically created for you, excluding The Work Crew's pre-existing materials, templates, systems, processes, prompts, methods, internal notes, know-how, generic frameworks, reusable components, software, stock materials, third-party materials, and tools.

Drafts, rejected concepts, internal work product, process notes, and unused options remain the property of The Work Crew unless expressly transferred in writing. Third-party assets remain subject to their own licences and restrictions.

6. Portfolio Use

Unless you request confidentiality in writing before delivery, The Work Crew may reference non-sensitive completed work in a portfolio, case study, internal training file, or promotional material. We will not intentionally publish private contact details, financial information, confidential business data, or sensitive personal information without consent.

7. Payment

Payment is required before work begins unless The Work Crew agrees otherwise in writing. For MVP testing, payment may be requested manually by email. Prices are in Canadian dollars unless stated otherwise. Taxes, platform fees, transfer fees, or transaction fees may apply where legally required or where charged by a payment provider.

An order is not active until payment is confirmed and all required information is received. We may correct obvious pricing, package, or clerical errors before accepting an order.

8. Timelines

Delivery timelines are estimates unless expressly guaranteed in writing. Timelines begin only after payment is confirmed and all required materials, instructions, access, and clarifications have been received. Delays caused by the client, third-party tools, inaccessible links, missing files, platform outages, force majeure, illness, staffing issues, or unclear instructions may extend timelines.

9. Revisions

Each fixed package includes one complimentary revision only, unless otherwise stated. A revision means a reasonable adjustment to the delivered work within the original scope. It does not include a new concept, new task, new direction, additional deliverables, change of strategy, change of brief, rework caused by missing or incorrect client information, or work outside the package.

10. Client Review

You must review deliverables promptly. Unless otherwise confirmed in writing, if you do not request the included revision within 3 calendar days after delivery, the order may be treated as accepted and closed. After closure, additional requests may require a new order and additional payment.

11. Prohibited Use

You may not use The Work Crew to create, promote, facilitate, or support unlawful, deceptive, harmful, exploitative, infringing, abusive, discriminatory, harassing, defamatory, spam, malware, privacy-invasive, impersonation, counterfeit, or rights-violating activity. We may refuse or cancel work that creates unacceptable legal, ethical, safety, reputational, platform, or operational risk.

12. No Guarantees

We do not guarantee business results, sales, leads, rankings, views, likes, followers, approvals, platform acceptance, search engine performance, ad account performance, revenue, employment, funding, immigration outcomes, legal outcomes, or any specific commercial result. You remain responsible for business decisions and use of deliverables.

13. Third-Party Platforms

Our work may reference or depend on third-party platforms such as Google, Gmail, Airtable, Canva, social media platforms, website hosts, payment providers, analytics tools, and file storage providers. We do not control third-party platforms and are not responsible for their outages, policy changes, errors, restrictions, account actions, fees, security incidents, or service limitations.

14. Confidentiality

We will take reasonable steps to treat non-public client information as confidential. You should not submit highly sensitive information unless necessary. Do not send passwords, government IDs, payment card numbers, health records, or other sensitive data unless we specifically request a secure method. We are not responsible for unnecessary sensitive information submitted by you.

15. Limitation of Liability

To the maximum extent permitted by law, The Work Crew and its owners, contractors, Crew Members, affiliates, suppliers, and representatives will not be liable for indirect, incidental, consequential, special, exemplary, punitive, reputational, data, profit, revenue, business interruption, loss of opportunity, or third-party damages.

To the maximum extent permitted by law, our total aggregate liability for any claim related to an order, deliverable, website use, or communication is limited to the amount you paid to The Work Crew for the specific order giving rise to the claim.

16. Indemnity

You agree to defend, indemnify, and hold harmless The Work Crew and its owners, contractors, Crew Members, affiliates, suppliers, and representatives from claims, losses, damages, liabilities, costs, and expenses arising from your materials, instructions, misuse of deliverables, breach of these Terms, breach of law, infringement, privacy violation, or third-party claim connected to your order.

17. Relationship

No employment, partnership, joint venture, agency, fiduciary, franchise, or representative relationship is created between you and The Work Crew. Crew Members and contractors are not authorized to bind The Work Crew or make promises on our behalf unless confirmed in writing by The Work Crew.

18. Changes

We may update these Terms at any time by posting a revised version on the website. The version posted at the time of your order generally applies to that order, unless a change is required by law or agreed in writing.

19. Governing Law

These Terms are governed by the laws of Ontario and the applicable federal laws of Canada. The courts located in Ontario will have jurisdiction, subject to any mandatory consumer protection rights that cannot legally be waived.
